Homicide charges 'likely' in child's death

Charges have been filed in the death of a 1-year-old Tuesday.

Brandy Ann Boyd, 25, and her boyfriend, Austin Levi Payne, 24, were arrested late Thursday after Boyd’s daughter was taken to Cartersville Medical Center at 10 p.m. Tuesday, reportedly not breathing, Bartow County Sheriff’s Office Sgt. Jonathan Rogers said.

The child was declared dead in the emergency room.

Rogers said Friday that the child showed signs of prolonged abuse and the trauma that may have led to her death did not occur Tuesday.

Coroner Joel Guyton said he had been involved only somewhat in the early stages and a cause of death is unknown. He did say the infant was “injured” but there were no signs of malnourishment.

He declined to comment further as the case remains under investigation.

The extent of the child’s injuries and a cause of death will be available once the Georgia Bureau of Investigation Medical Examiner’s Office produces the final autopsy, which Rogers expects over the weekend.

The investigator said any further charges are “likely going to be homicide.”

“We really believe it’s going to be upgraded to homicide,” he said.

Boyd was listed in an April 4, 2013, BCSO report as the girlfriend of Blake Cowart, whose body was recovered in the Etowah River almost three weeks after he was reported missing. Cowart’s obituary listed one daughter as a survivor.

Rogers said there were no signs Boyd or Payne were under the influence of alcohol or drugs Tuesday night.

The two are “somewhat cooperating,” he said, adding that, as of Friday afternoon, there was no attorney for either party.

When asked about other children, Rogers said Boyd has a 5-year-old child, which she does not have full custody of, and the Division of Family and Children Services has been notified.

Boyd and Payne were each arrested and charged with aggravated battery and first-degree cruelty to children.
