The deputies initially reported to the scene after being notified of a suspicious vehicle. While one deputy was talking to the driver, the other deputy was approached by a white male and white female who said another white male, later identified as Matthew Lowe, who was later arrested, had been following them around the store and was scaring several children.
The driver of the vehicle said the male they were speaking about was her boyfriend and she had been waiting for him for about an hour. The reporting deputy went into the store and observed Lowe, who was wearing black and purple yoga pants and a blue sweater that was inside out and backward. When Lowe saw the deputy, he turned and started walking the other way. The deputy was able to stop Lowe as he walked between two registers and I asked him what he was doing. Lowe said he did not know what he was doing. He said he did not know how he got to Wal-Mart and he was very confused. As the deputy spoke with Lowe, he was able to smell a strong odor of an alcoholic beverage on his breath. Lowe’s eyes were bloodshot and watery and he was very jittery. He kept shuffling from foot to foot and glancing around.
The deputy was then approached by the complainant, a manager at Wal-Mart, who said Lowe had been pouring shampoo out of bottles and was following children around the aisles scaring them. The deputy did observe dried shampoo on the sides of Lowe’s head and on his arms. He asked Lowe why he did this and he said he did not remember doing it. As Lowe damaged the property of another so as to create a hazardous condition and was intoxicated to the extent that he was unfit to care for his own safety or the safety of others, the deputy placed him under arrest for disorderly conduct.
Lowe’s girlfriend came into the store and indicated Lowe had been drinking all day and he does incredibly stupid things when he is drunk.
The complainant said she only located one bottle of Dial Triple Moisture shampoo that had been opened and Wal-Mart did not wish to seek criminal charges for the damage to the merchandise.
The deputy escorted Lowe to his patrol vehicle and placed him in the rear seat and transported Lowe to the Bartow County Adult Detention Facility, where he was released to jail staff without incident.
