Court documents indicate Jose Manuel Garcia, 30, formerly of Rudy York Road in Cartersville, is suspected of victimizing two boys, one under age 10 and the other less than 16 years old. Garcia is charged with two counts of aggravated sodomy and three counts of child molestation for alleged acts between 2002 and 2005.
In a motion for continuance filed Thursday, Garcia's attorney, John W. Lovett, said his client is not a citizen, but is in the country legally, and is detained pending the outcome of the case. Garcia was arrested in 2005, but not indicted until 2009.
Lovett said Assistant District Attorney Elizabeth York had announced the charges would be dismissed, then said the case would be placed on the dead docket. Garcia's attorney said Monday he received notice the state intended to produce evidence of similar transactions, and Thursday learned the case may be called for trial.
It is unclear if the case will be continued, and a court document lists similar transactions evidence of at least one child molestation case in Paulding County.
Woman who allegedly hit two people
with car may go to trial
The case of a local woman who allegedly hit two people in March while piloting a minivan also could be heard by a jury. Amanda Lynn Johnson, 30, of 319 Holcomb Road, Adairsville, is charged with two counts of aggravated assault, battery, three counts of third-degree cruelty to children, obstruction of an emergency phone call and two counts of reckless conduct.
Prosecutors allege Johnson during a domestic dispute put the Dodge Caravan in reverse and hit the accelerator, striking a woman and boy around 10 years old in the presence of two other children. Johnson then allegedly took the phone from another woman who was attempting to call 911.
Other defendants who could face juries include:
* Johnny Wayne Shook, 22, of 58 Oak Grove Road, Taylorsville, who is charged with aggravated child molestation, three counts of child molestation, statutory rape and enticing a child for indecent purposes.
* Kimberly Y. Cole, 27, of Cassville, who is charged with possession of marijuana with intent to distribute and possession of a firearm by a convicted felon.
