Cartersville City Council approves downtown microbrewery permit

The Cartersville City Council approved a special-use permit for an applicant looking to open a microbrewery inside the old fire station building at 19 North Erwin St. on Thursday evening. With Councilman Taff Wren absent for the Zoom-assisted meeting, Cartersville Mayor Matt Santini cast a decisive fourth “aye” vote allowing the item to pass. 

Councilmen Cary Roth and Calvin Cooley both voted against the request from Shelter Beer Co.

The Cartersville Planning Commission previously voted 5-1 to recommend approval of the special-use permit. The applicant entered into an agreement with the Cartersville Building Authority (CBA) on Feb. 13, with the initial lease term for the facility set at 10 years.

Per City documents, the tenant will have three opportunities to renew the lease subsequently, each in five-year intervals. For the first 10 years the rent is set at $94,500 annually. 

However, the CBA — in lieu of granting the applicant a "tenant improvement allowance" — has agreed to abate the rent over that initial 10-year period to the tune of $732,550. City documents indicate Shelter Beer Co. will receive a $284,450 abatement for the first three years of occupancy — essentially, eliminating the first three years of the tenant’s rent altogether. 

“Afterwards, the abatement shall be a straight-line abatement over the remaining term in the amount of $5,329.76 per month,” City documents read. “In addition to the abatement credit, [the] landlord will provide an additional abatement of $97,750 toward the installation of an elevator and construction of improvements of the premises related thereto.”

City documents indicate the proposed microbrewery will include a 1,780-square-foot, fenced-off outdoor patio area on the east side of the building. The proposed business hours are listed as 4-10 p.m. on Wednesday and Thursday, 1-11 p.m. on Friday and Saturday and 1-9 p.m. on Sunday.

The council also voted unanimously to approve an intergovernmental agreement with Bartow County for a proposed boat launch off Douthit Ferry Road.

Bartow County Commissioner Steve Taylor applied his signature to the agreement at a meeting one day earlier. The project would be funded via a Georgia Department of Natural Resources grant; once the County completes the project along Sam Smith Park, the City of Cartersville will take over maintenance and operations. 

Due to blowback from several residents along the Etowah River, the original plan for the project was modified. 

“The entrance and the location of that have been altered so it is not directly where it was before,” Santini said. “It has been moved downstream.”

Santini said the City has discussed plans to limit hours of access at the proposed boat launch, as well as a proposal to install bollards at the launch so that only canoes and kayaks can access the river, pending boat traffic becomes too heavy.

“According to the plans that I saw, they were going to gate it once you get past the Sam Smith parking lot,” said Cartersville Parks and Recreation Director Tom Gilliam. “There will be a gate there that our park attendants will lock so that people can’t get down there after hours.”

Cartersville Assistant City Attorney Keith Lovell said the parks and recreation department will develop more policies and procedures prior to the boat launch opening to the public. 

“They will be posted there for everyone to comply with,” he said. 

The council similarly approved an “emergency” amendment pertaining to the local golf cart ordinance. Whereas most amendments require two readings before the council can vote on a matter, this particular item required just one.

“The State of Georgia’s changed the code section’s numbers that are referenced in the City ordinance, and all these revisions do is, in the definitions, correspond to the correct code sections in the State law now,” Lovell said. 

During a work session held prior to Thursday evening’s meeting, City of Cartersville Planning and Development Director Randy Mannino discussed a proposed text amendment pertaining to the City’s swimming pool standards, particularly, fencing requirements.

“Typically, I’m against being more restrictive than State requirements, but the City adopts the State building code by reference,” he said. “In the latest version of the building code, the State did adopt an exception to that for those who have a certain mechanical cover or automated cover.”

Mannino described that exemption in two words — idiotic and absurd.

“Anybody can leave that cover open,” he continued. “From a safety perspective, we think that fence should be there, and we want to eliminate that exception out of the City requirements.”

To do so, Lovell said the City would have to submit its proposed changes to the Georgia Department of Community Affairs. 

“They have, I believe, a 30-day period where they can review that and give us their recommendation on it,” he said. “Then it is sent back to us, and at that point we can actually formally adopt the changes.”

Other items approved by council at Thursday evening’s meeting include:

— An administrative request to accept $69,000 in federal Coronavirus Aid, Relief and Economic Security (CARES) Act funding for the Cartersville-Bartow County Airport. Under the agreement, the local airport will receive $69,000 in Georgia Department of Transportation (GDOT) funding, with $15,903 set aside for insurance expenditures, $13,851 allocated for grounds repairs and maintenance and $13,500 reserved for utilities expenses.

— A request from the water department to pay Atlanta-based Flint Equipment Co. $157,000 for a John Deere high lift loader. “This machine will be used to move material from the newly constructed biosolids storage facility which was just completed in February,” a department summary recommendation reads. 

— A request from the water department to pay Marietta-based East Electrical Contractors, Inc. an amount not to exceed $150,000 for emergency pump repairs. According to a department summary report, a switchgear at High Service Pump Station No. 2 caught fire and could not be salvaged. “The loss of the pump comes at a particularly inopportune time,” the document reads. “The loss reduces pumping capacity at the plant by 14 million gallons per day, going into the peak-demand season of summer. Compounding the problem is an estimated 15-week lead time on the replacement equipment.” The replacement is not included in the City’s current fiscal year budget, but documents indicate funding for the purchase will be included in the City’s FY ’21 budget.
